Having a TLD for a particular country or being hosted in that country is enough to get preferential ranking for searches in that country.
Use the spam tool in Webmaster Tools instead of the public spam tool. A human reviews all the ones submitted via Webmaster Tools, but that's not the case for the public tool. Webmaster Tools spam submissions are also given more weight than the public submissions.
Don't worry about duplicate content when you have content localized for different countries - even if the content is in the same language, Google will figure out what you're doing and won't give you a duplicate content penalty.
